How To Sue After Car Crashes Caused By Trees

CarAccTree

We can never quite predict what will happen when we get behind the wheels of our cars. Sometimes, we arrive at our destination safely. In other situations, we crash into other vehicles on the way. And in some very rare situations, falling trees and other acts of nature cause serious damage. For one New Hampshire woman, this did much more than simply stopping her from reaching her destination. It robbed her of her life. But what can you do if your crash was caused by a tree in New Hampshire? Can you sue?

Woman Killed After Colliding With Falling Tree in New Hampshire

On November 30th, it was reported that a woman had lost her life after colliding with a falling tree in New Hampshire. The incident occurred in Sunapee at about 6:30 PM, and it seems as though the woman was left with almost no time to react. Investigators believe that the Rav4 was traveling south down Route 11 when a tree suddenly fell across the roadway. The vehicle then impacted the tree, causing almost immediate death for the driver. First responders arrived and pronounced her dead on the scene.

Suing for Situations Like These

But what if the woman had survived? Could she sue? What about her family members? Could they sue for a situation like this? At first glance, it seems that a lawsuit is unlikely. After all, you cannot sue a tree for negligence. And even if you could, the tree could not provide you with much compensation. In addition, it’s important to note that in New Hampshire, in order to receive compensation for injuries caused by another, you must prove that party did something negligent or reckless to cause your injuries.

In the case of a falling tree, you may be able to sue the property owner or government agency that was responsible for the land upon which the tree stood. You would need to prove that this entity knew or should have known that the tree posed a risk to motorists, and that it should have been removed or trimmed prior to the crash. This is no easy feat, but a qualified expert, like an arborist, may be able to help gather proof.
